Permit rules for driveways, patios, and sidewalks in Lake County are split across two levels of government, and that split is the source of most of the confusion. This guide lays out who does what in each of the 19 communities we serve, with a link to the source for every claim. Where a village or township does not publish its rules, we say so rather than guess.

The Two Layers

Building and zoning permits cover the slab on your own property. In 15 of the 19 communities, building permits are issued by the Lake County Building Department at 105 Main Street in Painesville, (440) 350-2636, per the county's published jurisdiction list. Four cities, Mentor, Willoughby, Eastlake, and Wickliffe, run their own building departments (Wickliffe sends only electrical to the county). On top of that, many cities and townships require their own zoning permit before the county will issue anything; Painesville, Willoughby Hills, Willowick, Concord Township, and Timberlake all say so on their websites.

Right-of-way permits cover the apron and the public sidewalk, the strip between your property line and the curb. Every city treats that strip as public land. Mentor's code requires a right-of-way construction permit and a surety bond for any driveway apron or sidewalk work; Willoughby has a dedicated right-of-way permit application. Aprons are poured thicker, 6 inches in Mentor, because they are plowed.

Contractor registration is a third thing that trips up homeowners hiring out-of-county crews. Mentor, Willoughby, Wickliffe, Willoughby Hills, and the county all require contractors to register, and Willoughby Hills requires it even if the contractor is already registered with the county. We hold the registrations the work requires.

What Typically Needs A Permit

  • New driveway or widened driveway: almost always a zoning or building permit. Mentor requires one for "any type of driveway construction or expansion."
  • Replacing a driveway in the same footprint: varies. Some communities treat it as maintenance; Eastlake inspects all exterior flatwork regardless.
  • Apron or sidewalk: always a right-of-way permit, usually a bond, usually an inspection of the forms before the pour.
  • Patio at grade: often zoning only, sometimes nothing. Attached, raised, or with steps: more likely a building permit.
  • Garage floor: interior slab replacement is usually not permitted separately unless the garage structure is touched; Eastlake inspects interior flatwork.
  • Steps and porches: a building permit in most communities because they attach to the structure and need footings.

Mentor

Mentor requires a permit for any driveway construction or expansion, and a separate right-of-way permit (with a surety bond) for the apron or any work between the sidewalk and the curb. The city spec is 4-inch minimum driveways, 6-inch aprons, 4-inch aggregate base, ODOT 499 Class C concrete with 5–7% air, graded to drain with no runoff onto neighbors. Aprons are limited to 24 feet wide at the right-of-way.

Inspections And Timing

Where a permit is required, expect at least one inspection: the forms and base before the pour, so the inspector can check thickness, base depth, and grade against the standard, and sometimes a final. Mentor's residential permit guide lists an apron, driveway, and sidewalk inspection before each pour. That inspection is the reason we set forms the day before and call it in; it adds a day to the schedule and it protects you, because an inspector who sees 6 inches of formed depth and compacted stone is confirming the same spec that is on your quote. Permits in most Lake County offices are issued within a few business days for residential flatwork; right-of-way permits with a bond can take a week. We build that into the start date on the quote so nobody is waiting on paperwork with a truck ordered.

Do I need a permit for a concrete patio in Lake County?

It depends on the community. A patio at grade on your own lot often needs only a zoning permit or none at all; Eastlake inspects all exterior flatwork, and Timberlake issues a zoning permit for detached patios. Anything attached to the house, raised, or with steps is more likely to need a building permit. We check with the office before we quote.

Who pulls the permit, me or the contractor?

The contractor should. Most Lake County cities require the contractor to be registered with the city or the county before a permit is issued, and the inspector wants to talk to whoever is pouring. We pull it and put the fee on your quote at cost.

What happens if the work is done without a permit?

Wickliffe doubles the fee. Other cities can require the work to be removed, and an unpermitted apron can become your problem when the city resurfaces the street. It is not worth the $50 to $200 saved.

Why does the apron need a separate permit from the driveway?

The apron sits in the public right-of-way, which the city owns and plows. Cities require a right-of-way permit, often a bond, a thicker pour (6 inches in Mentor), and an inspection before and after.
